Pittsburg man Damond Lazenby Jr. disappeared Jan. 1 after his green Volkswagen was found abandoned with its engine running near a Highway 4 overpass at Port Chicago Highway in Concord.

After family members reported his absence, they marshalled multiple search parties to canvass roadways around the region up to Jan. 7, when Lazenby’s body was found on an embankment near the shoulder of eastbound Hwy. 4 between Port Chicago Highway and Willow Pass Road.

On Monday, the CHP’s Golden Gate Division posted a statement to social media saying that investigators believe Damond Lazenby Jr. was struck by the right front part of a dark-colored sedan whose driver fled the scene.

Investigators have yet to share additional details about Lazenby’s death, pending results of an autopsy.

Police said they began investigating after learning seven vehicles near Brentwood Boulevard between Sunset Road and Homecoming Way had been struck by BB pellets or other objects from 5:40 a.m. Friday to 1:40 a.m. Saturday.

After asking residents and pedestrians in the area to take care and share any suspicious activity, investigators managed to recover undisclosed evidence that led to a 31-year-old man’s Almond Street home just after 5 p.m. Saturday.

Within the hour, the 31-year-old was arrested and booked into Martinez county jail on suspicion of recklessly discharging projectiles at moving vehicles. He was listed in custody at the jail and held on $140,000 bail, according to a county records check Sunday night.

It was the department’s second such investigation within two months, following the arrest of a 19-year-old man later charged by the Contra Costa County District Attorney’s Office with shooting into an occupied home.

Police were asking anyone with information to call Brentwood police at 925-809-7911.

According to a social-media post by the CHP’s Santa Cruz office, a CHP officer responded around 11:15 a.m. to a call reporting a car stuck in a ditch in the 800 block of Old Mill Pond Road, near the Glenwood area of the Santa Cruz Mountains.

When the officer arrived, he found the car was “not teetering on a ditch but in fact, teetering on the side of a cliff!”

Within a few minutes, the officer managed to soothe and calm three people inside the car, who were “scared for their lives” and “in disbelief.”

After carefully following the officer’s “clear and concise instructions on how to safely exit the car,” the three were able to get out safe and sound.

Alongside images of the car balanced on the cliff edge by one rear tire, the CHP warned residents about exercising caution.

“Again, we cannot stress this enough. Please ONLY drive if it’s necessary,” the post said in closing.

“If you do need to drive please slow down, be aware of your surroundings, and give enough space between yourself and surrounding vehicles.”

Richmond man gets prison for selling child porn https://www.eastbaytimes.com/2023/01/13/richmond-man-gets-prison-for-selling-child-porn/ https://www.eastbaytimes.com/2023/01/13/richmond-man-gets-prison-for-selling-child-porn/#respond Sat, 14 Jan 2023 05:05:40 +0000 https://www.eastbaytimes.com/?p=8716318 OAKLAND — A judge sentenced a 24-year-old Richmond man Thursday to a decade in prison over use of a messaging platform to sell and offer child pornography in exchange for gift cards, the U.S. Justice Department said.

According to a statement, Tariq Lamont Johnson pleaded guilty last June after admitting to using an account on Telegram “to sell visual depictions of a minor engaged in sexually explicit conduct to another person,” as well as several interlinked Instagram accounts, in exchange for Amazon gift cards.

Johnson admitted that on Nov. 5, 2021, he told a person he later learned was a Homeland Security Investigations agent who had contacted him that he could provide images for money.

He then sold the agent access to a Telegram chatroom and a link to hosted material on a cloud-storage site in exchange for a $25 gift card.

Soon after, he sold the agent a second link to similar cloud-stored material, with “more than 600 depictions of minors engaged in sexually explicit conduct” including depictions of infants and toddlers, for a $45 gift card.

On March 4, 2022, the government charged Johnson with a count of distribution of child pornography.

U.S. District Court Judge Jon Tigar sentenced Johnson on Thursday to ten years in prison, as well as a ten-year term of supervised release.

Tigar also ordered a hearing on April 6, 2023, to look into restitution for Johnson’s victims.

Alameda County DA charges suspect with murder of 71-year-old postal worker https://www.eastbaytimes.com/2023/01/12/alameda-county-da-charges-suspect-with-murder-of-postal-worker/ https://www.eastbaytimes.com/2023/01/12/alameda-county-da-charges-suspect-with-murder-of-postal-worker/#respond Fri, 13 Jan 2023 02:23:50 +0000 https://www.eastbaytimes.com/?p=8715301 OAKLAND — For years, Dilma Franks-Spruill had safely made the few blocks’ walk to her West Oakland home from her job at the main post office, authorities said.

She did not make it Wednesday morning.

The 71-year-old mother was confronted and stabbed without provocation multiple times by a man she did not know about 12:30 a.m. Wednesday in the 1500 block of Eighth Street, authorities said. She died at the scene.

The vicious attack happened about a block from her home.

On Thursday, 28-year-old Wilbert Winchester, a transient, was charged with murder and other crimes in Franks-Spruill’s death as well as attempted murder in the stabbing of another woman Monday morning on an AC Transit bus in East Oakland, according to authorities and court records.

The victim in the bus stabbing is a 59-year-old woman. The unprovoked attack happened while she was a passenger on a bus traveling in the 3400 block of International Boulevard. In a social-media post, Oakland police said officers responded shortly before 1 a.m. Monday to the 3400 block of International Boulevard for a reported knife assault, and arrived to find her suffering from multiple stab wounds. The suspect fled the bus but was later identified as Winchester.

According to an Oakland police officer’s probable-cause declaration within charging documents obtained Thursday from the Alameda County District Attorney’s Office, officers responded to the Wednesday assault after a caller told a dispatcher that a man had his foot on a woman’s neck and that the woman was yelling for help.

When officers arrived, they found the woman suffering from multiple stab wounds, and called paramedics and Oakland Fire Department firefighters for help. Despite first responders’ efforts, the woman was pronounced dead at 1:03 a.m.

After speaking with a witness in the area, an officer learned the attack was likely part of a series of unprovoked attacks by a suspect with a similar description who struck victims in the face or head with a metal pole. In at least one attack, the suspect also slashed a victim multiple times with a knife or box cutter.

About two hours after the attack, two officers saw a man matching the suspect description walking in the 2100 block of Lakeshore Avenue and carrying a metal pipe. When the officers detained him, they saw there was blood on a pair of off-white gloves he was wearing, and confiscated a green box cutter with what appeared to be blood on it.

After other officers helped quickly set up an in-field lineup, the previous witness said the suspect, identified as Winchester, “looked like the person that assaulted the murder victim.”

Officers arrested him on suspicion of murder and took him to police headquarters. After advising him of his rights, police said Winchester “placed himself in the area of the homicide at the time of the homicide, but denied any involvement.”

Police have not determined a motive for either attack. Neither family members nor post-office representatives could be immediately reached for comment Thursday.

The stabbings he is now charged with are not the only times Winchester is accused of attacking a woman at random.

According to court records, in March of 2017, he was arrested and charged with kicking a 73-year-old woman in the head aboard a San Francisco-bound BART train in Oakland causing the woman to be hospitalized.

Winchester did not know the woman. In that case, he was initially charged with assault causing great bodily injury and false imprisonment of an elderly person.

In a plea bargain in May of 2018, he pleaded no contest to the false imprisonment count and in August 2018 was given a three-year prison sentence with more than a year’s credit for time served. He was also ordered to make financial restitution to the victim who was given a 10-year protective order against him, court records show.

According to court records, Winchester was also convicted in February 2017 of a December 2016 battery on a transit passenger and was later placed on three years probation. There were no additional details available about that case.

Winchester was in custody Thursday night at Santa Rita Jail without bail and was arraigned on the charges Friday morning at Oakland’s Wiley W. Manuel Courthouse. He is scheduled to return to court for a plea hearing on Feb. 3.

Both men — a 23-year-old who was shot in the arm and a 28-year-old who was wounded in the leg — were in stable condition, police said.

The shooting happened shortly after 3:10 p.m. Thursday in the 8900 block of MacArthur Boulevard.

Police said the two men were part of a larger group standing outside when a man began shooting at the group.

The two men were the only ones hit by the gunfire, authorities said. They got their own transportation to a hospital.

Police have not yet determined a motive for the shooting or if the two men wounded were the intended targets.

The gunman fled in a vehicle, police said.

Multiple bullet casings were recovered at the scene and streets were blocked off while police investigated.

Police and Crime Stoppers of Oakland are offering up to $10,000 in reward money for information leading to the arrest of the suspect. Anyone with information may call police at 510-238-3426 or Crime Stoppers at 510-777-8572.

According to police, officers responded around 9:15 a.m. Dec. 15, 2022 to a home in the 100 block of Dunedin Drive for a shooting report. When officers arrived, they found multiple shell casings at an intersection near the home, where residents were inside. The home was hit but no one was wounded.

Information from other neighborhood residents helped investigators identify a silver four-door Infiniti G37 sedan as a possible suspect vehicle, which detectives were able to find and recover the next day.

The shooting suspect was arrested on a warrant Saturday and taken to Martinez county jail, where he was held on $250,000 bail.

The district attorney’s office charged Pena Tuesday with felony shooting into an inhabited dwelling. He faced an arraignment hearing Wednesday at Martinez Superior Court, according to a jail records check.

Although a motive for the shooting was still under investigation, detectives said they believe the Infiniti’s pre-existing bullet holes may be a sign of involvement in a prior shooting.

San Leandro: Firefighter arrested on suspicion of child-porn possession https://www.eastbaytimes.com/2023/01/09/san-leandro-firefighter-arrested-on-suspicion-of-child-porn-possession/ https://www.eastbaytimes.com/2023/01/09/san-leandro-firefighter-arrested-on-suspicion-of-child-porn-possession/#respond Tue, 10 Jan 2023 01:01:06 +0000 https://www.eastbaytimes.com/?p=8710487 SAN LEANDRO — An Alameda County Fire Department firefighter was in a county jail Monday after his weekend arrest at a fire station on suspicion of possession of child pornography, authorities said.

According to statements by San Leandro city staff and the Mariposa County Sheriff’s Office, Charles “Chuck” Harris, 42, of Greeley Hill, was taken into custody Sunday morning in the 1000 block of 143rd Avenue in San Leandro after his arrest under a Ramey warrant on suspicion of possession and distribution of multiple child-pornography files. Harris was later booked into Mariposa County’s adult detention facility and held on $50,000 bail.

Officials shared limited details Monday due to what they described as ongoing investigations’ sensitive nature, but did say tips from the National Center for Missing and Exploited Children prompted three initial investigations that led to Harris’ arrest by Mariposa County sheriff’s deputies, members of the Central California and Silicon Valley Internet Crimes Against Children Task Forces, and the Federal Bureau of Investigation.

“The safety and protection of children is one of the most important jobs we have. Children need to know they are safe,” Mariposa County Sheriff Jeremy Briese said. “I am extremely proud of the swift and professional job our Detectives and partner agencies did, always working together so our communities are safer.”

“These allegations, if proven true, are deeply concerning and undermine the public’s trust in our public safety service,” San Leandro Mayor Juan Gonzalez said Monday.

“We will work closely with our partner agencies to ensure that justice is served. Each day, our community places its trust in our public safety staff, and we absolutely understand the anger and disappointment caused by the arrest of a first responder.”

San Leandro city staff said Harris, who worked in the city, was placed on paid administrative leave under his fire department collective bargaining agreement. An Alameda County Fire Department spokesperson reached Monday afternoon had no comment due to the ongoing investigation, but the department later acknowledged the firefighter’s arrest at a fire station Sunday.

“ACFD is not at liberty to disclose any additional information at this time, however; our department supports our law enforcement partners and is fully cooperating with all agencies involved,” a department statement released Monday night said. “The safety and trust of our residents are of the highest priority at all levels. Alameda County Fire Department is committed to protecting our communities and takes pride in dedicating ourselves to excellence. Our members will remain steadfast in their dedication to providing superior service to our community.”
